I agree to participate in one or more physical fitness programs by A Tribe Called Sprinters LLC, which may include EVERYDAY PEOPLE COMBINE, A Tribe Called Sprinters Clinic, and/or any training by any affiliate, subsidiary or partner of A Tribe Called Sprinters LLC (collectively, A Tribe Called Sprinters USA). A Tribe Called Sprinters USA fully informed me that the fitness event it offers and in which I wish to participate are extremely strenuous and may push the limits of my physical abilities. I understand that the events have risks which may include injury to the musculoskeletal and/or cardio respiratory systems which can result in serious injury or death, injury or death due to negligence on the part of myself or people around me, injury or death due to improper use or failure of equipment, or injury or death due to a medical condition, whether known or unknown by me. I am aware that any of these risks may result in serious injury or death to me and/or others.
I assume full responsibility for all risks that I expose myself to by my participation in A Tribe Called Sprinters USA programs and accept full responsibility for any injury or death that may result from participation in any activity, class or fitness program. I know of no medical conditions that would increase my risk of illness or injury by participation in a fitness program designed by A Tribe Called Sprinters USA. A Tribe Called Sprinters USA informed me of the possibility of adverse physical changes during an exercise program, and I understand the same. A Tribe Called Sprinters USA informed me that these changes could include abnormal blood pressure, fainting, disorder of heart rhythm, stroke, and heart attack or even death, and I understand the same. Understanding the above information, I willingly assume any and all risk associated with my participation in A Tribe Called Sprinters USA fitness programs.
RELEASE, WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT:
Acknowledging the above mentioned risks and considering that I am voluntarily participating in the activities made available by A Tribe Called Sprinters USA and with my full understanding of all of the above, I waive, release, and discharge A Tribe Called Sprinters USA and its agents of any and all liability, claims, demands, actions or causes of action, or damages related to my participation in A Tribe Called Sprinters USA fitness programs, including claims attributed to any negligent acts or omissions of the above mentioned parties. This agreement is binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any part of this agreement is held invalid, the remainder shall remain in full legal force and effect. If signing on behalf of a minor child, I permit any person connected with A Tribe Called Sprinters USA to administer first aid, call for medical care for the child, and transport the child to a medical facility deemed necessary for the wellbeing of the child.
INDEMNIFICATION: I accept financial responsibility for any injury that I or the participant on whose behalf I am signing cause to my/him/herself or to any other participant due to my/his/her negligence. Should the above-mentioned parties, or anyone acting on their behalf, incur attorney’s fees or costs to enforce this agreement, I agree to reimburse them for such fees or costs. I agree to indemnify and hold harmless A Tribe Called Sprinters USA, its principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and property damage that may result from my negligent or intentional act or omission while participating in activities offered by A Tribe Called Sprinters USA.
USE OF PICTURES/FILM/LIKENESS: I agree to allow A Tribe Called Sprinters USA and its agents to use any picture, film and/or likeness of me for advertising purposes. In the event I choose not to allow the use of the same for said purpose, I agree that I must inform A Tribe Called Sprinters USA of this in writing.
I have fully read and understand the foregoing assumption of risk, and release of liability and I understand that signing obligates me to indemnify the parties named for any liability for injury or death of any person and property damage caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
